<p><strong>How does the second generation Stratus compare to the first generation?</strong></p>
<p>Both the first and second generation Stratus are capable ADS-B weather receivers. The second generation Stratus adds a second (1090 MHz) radio for receiving more air-to-air traffic, adds an AHRS to support additional app displays and gives the pilot the ability to remote the GPS antenna to provide for additional mounting options.</p>
<p><strong>Does Appareo have a trade-in policy for the first generation Stratus?</strong></p>
<p>No, Appareo is not offering a trade-in policy for first generation Stratus.  Appareo remains committed and will continue to support the first generation Stratus.  In fact, a recent free firmware update upgraded the first-generation Stratus to include the ability to display 978 traffic on ForeFlight Mobile.</p>
<p><strong>The GPS in my second generation Stratus stops working when my aircraft is flying above 35,000 feet. Why is this happening?</strong></p>
<p>Appareo is tracking a known issue where pilots flying aircraft at 35,000 feet or higher stop seeing a GPS solution from Stratus (firmware version 1.0), despite seeing green satellites on the Stratus Status page. Appareo is currently working on a fix that will be released as a free firmware update to Stratus in the near future. This firmware update will be released  in conjunction with a future update to ForeFlight Mobile.  If you plan to fly at 35,000 feet or higher with a second generation Stratus, you should arrange for an alternative GPS source to prevent ForeFlight Mobile and Stratus Horizon from losing their position source.</p>
<p><strong>What are the dimensions of the second generation Stratus?</strong></p>
<p>Stratus measures 2.6 inches wide, 6 inches deep, and 1.25 high and weighs 9.7 oz.</p>
<p><strong>What apps does Stratus work with?</strong></p>
<p>Stratus works exclusively with ForeFlight Mobile and Stratus Horizon.</p>
<p><strong>How does Stratus communicate with my iOS device?</strong></p>
<p>Stratus connects to your iOS device via a WiFi network.</p>
<p><strong>Which iPads are compatible with Stratus?</strong></p>
<p>The second generation Stratus will work with the iPad 2, third generation iPad, and the iPad mini. Due to app compatibility issues, the second generation Stratus will not work with the first generation iPad.</p>
<p><strong>Which iPhones are compatible with Stratus?</strong></p>
<p>We strongly recommend an iPhone 4, iPhone 4S, iPhone 5 or the third or fourth generation iPod touch.</p>
<p><strong>Can more than one iOS device connect to Stratus?</strong></p>
<p>Yes. In fact, every iOS device running ForeFlight Mobile and/or the Stratus Horizon app  in the cockpit can simultaneously be connected to Stratus and see the same weather unfold.</p>
<p><strong>Does Stratus provide GPS location information?</strong></p>
<p>Yes, Stratus includes a GPS/WAAS receiver and will provide GPS information to ForeFlight Mobile. Since Stratus is battery operated and can operate for up to 8 hours, Stratus will keep a constant GPS signal and make that available to ForeFlight Mobile.</p>
<p><strong>I just received my Stratus and am able to successfully connect my iPad to its wireless network. Why am I able unable to connect Stratus to ForeFlight Mobile?</strong></p>
<p>Versions of ForeFlight Mobile earlier than 5.1 are not compatible with the second generation Stratus. Update ForeFlight Mobile via the App Store on your iOS device and reattempt to connect your Stratus to ForeFlight Mobile.</p>
<p><strong>What type of ADS-B signal is represented by the ADS-B LED of Stratus?</strong></p>
<p>The ADS-B LED will light up when signal has been received in the past three seconds from an ADS-B tower. The ADS-B LED is not activated by air-to-air ADS-B traffic.</p>
<p><strong>Where should I place Stratus in my aircraft?</strong></p>
<p>A snap-in mount is included with Stratus.  A suction cup mount is also available for purchase from your Stratus retailer.</p>
<p>If using the snap-in mount to place Stratus in your aircraft, the mount should be placed on the glareshield as close as practical to the pilot and copilot seats to help prevent overheating as it will be easier for Stratus to draw the cool air from the cabin through its fan. The LEDs and Stratus logo should face the back of the aircraft. If Stratus is facing the wrong direction, AHRS data will be incorrect and the chance of overheating will be significantly increased as the fan draws cool air from the front of the device and vents the air through the back.</p>
<p>Stratus contains both internal ADS-B and GPS antennas, allowing for no wire operation.  External ADS-B and GPS antennas may be purchased from your retailer; however, allowing for Stratus to be placed in areas of the aircraft that may have poor ADS-B and/or GPS reception.</p>
<p>If you are using Stratus with the Stratus Horizon AHRS app, mount Stratus so that it is perpendicular to the back of the aircraft and parallel to the aircraft’s centerline (the roll axis), as shown in the figure below.  If using the suction cup mount, Stratus may still be placed parallel to the window as long as the device is facing the right direction (Stratus logo and LEDs facing the back of the aircraft) and parallel to the aircraft&#8217;s centerline.</p>

<p><strong>Do I need an external ADS-B antenna?</strong></p>
<p>Most pilots will not require an external ADS-B antenna and can thus operate completely wire-free. Stratus includes a specially tuned, high-performance internal antenna that will get good reception in many aircraft. Some aircraft; however, may require an external antenna due to signal attenuation caused by the aircraft. If you find you need an external antenna, you may purchase from the Appareo’s Stratus accessory page.</p>
<p><strong>Do I need an external GPS antenna?</strong></p>
<p>The external GPS antenna is an optional accessory for your second generation Stratus. Stratus contains an internal GPS antenna that will be sufficient for many pilots. The external GPS antenna; however, provides any more options for placing Stratus in your aircraft and resolves reception issues caused by heated windshields. You may purchase an external GPS antenna.</p>
<p><strong>Does Stratus provide GPS location information?</strong></p>
<p>Yes. Stratus includes a GPS/WAAS receiver and will provide GPS information to ForeFlight Mobile. Since Stratus is battery operated and can operate for up to 8 hours, Stratus will keep a constant GPS signal and make that available to ForeFlight Mobile.</p>

<p>No, Stratus does not work in any country other than the United States. Stratus receives its data from ground-based ADS-B towers broadcasting on UAT (978). This service is not available outside of the United States.</p>

<p><strong>I just received my Stratus and am able to successfully connect my iPad to its wireless network. Why am I able unable to connect Stratus to ForeFlight Mobile?</strong></p>
<p>Versions earlier than 5.1 of ForeFlight Mobile do not support the second generation Stratus. If your iPad is running an older version of ForeFlight Mobile, update the app and try again to connect to Stratus.</p>

<p><strong>Can I dim the Stratus LEDs for flying at night?</strong></p>
<p>Yes, you may dim or brighten the LEDs using the LED Brightness slider on the Stratus status page within the ForeFlight Mobile app.</p>

<p><strong>How do I register my Stratus?</strong></p>
<p>When you purchase Stratus from Appareo or Sporty&#8217;s, the unit will automatically be registered. No further action is required to register your unit.</p>
<p><strong>How will my Stratus receive firmware updates?</strong></p>
<p>Stratus firmware updates will be available within ForeFlight Mobile. Updates to ForeFlight Mobile will be available via the App Store.</p>
<p><strong> </strong></p>
<p><strong>I looked on your coverage map and noticed that ADS-B is not available in all of the areas I fly. Do you know when it will be available in specific areas of the country?</strong></p>
<p>The FAA expects to have full coverage in the United States by early 2014. Information regarding the location of future ADS-B stations is not shared with Appareo, however.</p>

<p><strong>Does Stratus work in helicopters?</strong></p>
<p>Yes, Stratus would be usable in a helicopter, provided there adequate ADS-B coverage in the area you are flying to mitigate potential signal blockage due to flying at low altitudes.</p>
<p><strong>I am trying to use the Stratus Updater app to update my Stratus second generation firmware, but I am getting an error message. Why isn&#8217;t it working?</strong></p>
<p>The Stratus Updater app currently only supports Stratus first generation firmware updates.  A firmware update has not been released for the Stratus second generation, but future updates will be made available via ForeFlight Mobile app updates.</p>
<h3 id="weather">Weather FAQs</h3>
<p><strong>What weather products are available?</strong></p>
<p>Stratus receives and transmits to ForeFlight Mobile CONUS NEXRAD, regional high-resolution NEXRAD, METARs, TAFs, TFRs, AIRMETs, SIGMETs, NOTAMs, pilot reports, and winds/temperature aloft. Each product is integrated with ForeFlight Mobile’s Airports and Maps features.</p>
<p><strong>Does Stratus replace XM Weather?</strong></p>
<p>No, the products provided by Stratus and the ADS-B network differ. XM Weather offers a wider array of products and more coverage. Many pilots will find adequate ADS-B coverage within the areas they fly most frequently. Refer to the Stratus Coverage Map to determine if there is coverage for your region.</p>
<p><strong>Are there any subscription fees associated with ADS-B weather?</strong></p>
<p>No; however, Stratus does require a current ForeFlight Mobile subscription. ForeFlight Mobile Pro subscribers will enjoy improved position accuracy when using Stratus as a GPS source.</p>
<h3 id="traffic">Traffic FAQs</h3>
<p><strong>Can I get traffic information from Stratus?</strong></p>
<p>Yes, the first generation Stratus receives traffic on the 978 MHz (UAT) frequency and the second generation receives it on both the 978 MHz and 1090 MHz (ES) frequencies.</p>
<p>The traffic you see on ForeFlight Mobile is only ADS-B traffic. ADS-B traffic only includes the air-to-air traffic received directly from another aircraft and traffic rebroadcast to your aircraft from an ADS-B ground tower.  Air-to-air traffic reports are only reported from ADS-B Out equipped aircraft; few aircraft are currently ADS-B Out equipped. You will only receive ADS-B traffic from a ground tower if two things are true: 1) your aircraft, or another one nearby you, is ADS-B equipped, and 2) you are in communication with an ADS-B ground tower.</p>
<p>Remember, ADS-B traffic, even at its best, is not a complete picture of nearby traffic and is not a substitute for looking out the window when fulfilling your responsibility to see and avoid.</p>

<h3 id="battery">Battery FAQs</h3>
<p><strong>Is Stratus battery powered?</strong></p>
<p>Yes, Stratus includes a battery that will provide continuous power for up to 8 hours, which contributes to making Stratus operation wire-free for most pilots. You can charge Stratus using the include wall charger or using an accessory like one of the several commercially available 12V DC power adapters.</p>
<p><strong>Which part of the second generation Stratus’s USB port do I plug the battery charger into?</strong></p>
<p>The USB port of Stratus contains two parts. Insert the charging cable into the larger, left part of the port, which is marked with the battery symbol. The smaller, right part of the port is not used right now and allows for future functionality of Stratus.</p>
<p><strong>How long will it take to fully charge the battery of my Stratus?</strong></p>
<p>If the second generation Stratus’ battery is fully depleted it will take about 5.5 hours to recharge to 100%.</p>
<p><strong>May I charge Stratus from a laptop?</strong></p>
<p>No, laptops generally only supply up to 0.5 Amps of power per the USB 2.0 standard. Stratus, like an iPad,  requires a 2.0 Amp power source for it to properly charge.</p>
<p><strong>May I use a USB cable other than that one that was included with Stratus to charge the device?</strong></p>
<p>No, the included 3 foot USB cable is designed to enable optimal charging speed. Many other 3 foot USB cables will not be able to deliver as much power resulting in longer charge time. Similarly, a longer cable is not able to supply as much power as a shorter one and will also result in longer charge times.</p>
<p><strong>Will Stratus’s battery charge if it is both plugged-in and operating in an aircraft?</strong></p>
<p>Yes, Stratus will still charge its battery when running but only if it is plugged into a high-capacity 2.0 Amp charging source and only if the battery temperature is between 0 and 35 C.  If it is plugged in but the battery is too hot or too cold then Stratus may continue to operate but the battery will no longer charge to protect it from damage.</p>

<p><strong>Does Stratus’s battery have a finite life?</strong></p>
<p>Yes, Stratus contains a Lithium-ion battery. If stored and operated in its published temperate range its battery should last a long time and be capable of being fully discharged about 300 times before requiring service.</p>
<p><strong>Can I damage Stratus’s battery if I store or operate it outside of its rated ranges?</strong></p>
<p>Yes, operating and storing a lithium-ion battery when it is too hot will cause permanent damage and void Stratus’s warranty. A fully charged lithium-ion battery stored at 60 C for three months can permanently lose as much as 40% of its capacity. Do not to leave Stratus in a hot aircraft or automobile when it’s not in use.</p>
<h3 id="horizon">Stratus Horizon App (AHRS) FAQs</h3>
<p><strong>What is Stratus Horizon?</strong></p>
<p>Stratus Horizon is an app that works in conjunction with Stratus. Stratus Horizon shows the real-time AHRS (attitude, heading, and reference system) data of your aircraft, as measured by your Stratus device.</p>
<p><strong>Where do I get the Stratus Horizon app?</strong></p>
<p>Stratus Horizon may be downloaded for free from App Store. Type “Stratus Horizon” in the App Store search field to download. Stratus Horizon works on the same iOS devices as ForeFlight Mobile.</p>
<p><strong>How does Stratus Horizon get its AHRS data?</strong></p>
<p>Stratus Horizon derives ground speed, tracking, altitude, and vertical speed from the GPS signal it receives from Stratus. The aircraft&#8217;s attitude (roll and pitch)  is derived from Stratus&#8217;s accelerometers and gyroscopes.</p>
<p><strong>Can I use Stratus Horizon in portrait orientation?</strong></p>
<p>No. At this time, Stratus Horizon only works in landscape orientation.</p>
<p><strong>Stratus Horizon is unable to calibrate heading. Why is this happening?</strong></p>
<p>In order to calibrate heading, Stratus requires movement of the aircraft. If you are using Stratus in a stationary environment (e.g. your home or a non-moving aircraft), Stratus Horizon will not be able to calibrate heading.</p>
<p><strong>The course heading display shown on Stratus Horizon does not match the course shown on my other avionics. Why is this happening?</strong></p>
<p>Versions 1.0.0 and 1.0.1 of Stratus Horizon do not correct the reported course for variations in the earth&#8217;s magnetic model. Appareo is tracking a known issue and is currently working on an update to the Stratus Horizon app that will solve this issue. We anticipate this update will be released late June 2013.</p>

<p><strong>Which iPads are compatible with Stratus?</strong></p>
<p>Due to the amount of data processing required to display ADS-B weather, we strongly recommend using an iPad 2 or a third-generation iPad  with Stratus. Stratus is also compatible with the iPad mini.</p>
<p><strong>Which iPhones are compatible with Stratus?</strong><br />
We strongly recommend an iPhone 4, iPhone 4S, iPhone 5 or the third or fourth generation iPod touch.</p>
<p><strong>Can more than one iOS device connect to Stratus?</strong></p>
<p>Yes. In fact, every iOS device running ForeFlight Mobile in the cockpit can simultaneously be connected to Stratus and see the same weather unfold.</p>
<p><strong>Do I need an external ADS-B antenna?</strong></p>
<p>Most pilots will not require an external ADS-B antenna and can thus operate completely wire-free. Stratus includes a specially tuned, high-performance internal antenna that will get good reception in many aircraft. Some aircraft; however, may require an external antenna due to signal attenuation caused by the aircraft. If you find you need an external ADS-B antenna, you may purchase one from the Stratus accessory page. Please note that external GPS antennas are compatible with second generation Stratus only.</p>
<p><strong>Does Stratus provide GPS location information?</strong></p>
<p>Yes. Stratus includes a GPS/WAAS receiver and will provide GPS information to ForeFlight Mobile. Since Stratus is battery operated and can operate for up to 8 hours, Stratus will keep a constant GPS signal and make that available to ForeFlight Mobile.</p>
<p><strong>Does Stratus provide GPS information for applications other than ForeFlight Mobile?</strong></p>
<p>No, Stratus will not provide GPS information to other applications.</p>
<p><strong>Does Stratus work outside of the United States?</strong></p>
<p>No, Stratus does not work in any country other than the United States. Stratus receives its data from ground-based ADS-B towers broadcasting on UAT (978). This service is not available outside of the United States.</p>
<p><strong>I just received my Stratus and am able to successfully connect my iPad to its wireless network. Why am I able unable to connect Stratus to ForeFlight Mobile?</strong></p>
<p>Versions earlier than 4.5 of ForeFlight Mobile do not support the first generation Stratus. If your iPad is running an older version of ForeFlight Mobile, update the app and try again to connect to Stratus.</p>
<p><strong>Can I dim the Stratus LEDs for flying at night?</strong></p>
<p>Yes, you may dim or brighten the LEDs using the LED Brightness slider on the Stratus status page within the ForeFlight Mobile app.</p>
<p><strong>How do I register my Stratus?</strong></p>
<p>When you purchase Stratus from Appareo or Sporty&#8217;s, the unit will automatically be registered. No further action is required to register your unit.</p>
<p><strong>How will my Stratus receive firmware updates?</strong></p>
<p>Stratus firmware updates will be available within ForeFlight Mobile. Updates to ForeFlight Mobile will be available via the App Store.</p>
<p><strong>I looked on your coverage map and noticed that ADS-B is not available in all of the areas I fly. Do you know when it will be available in specific areas of the country?</strong></p>
<p>The FAA expects to have full coverage in the United States by early 2014. Information regarding the location of future ADS-B stations is not shared with Appareo, however.</p>
<p><strong>Does Stratus work in helicopters?</strong></p>
<p>Yes, Stratus would be usable in a helicopter, provided there adequate ADS-B coverage in the area you are flying to mitigate potential signal blockage due to flying at low altitudes.</p>
<h3 id="weather1">Weather</h3>
<p><strong>What weather products are available?</strong></p>
<p>Stratus receives and transmits to ForeFlight Mobile CONUS NEXRAD, regional high-resolution NEXRAD, METARs, TAFs, TFRs, AIRMETs, SIGMETs, NOTAMs, pilot reports, and winds/temperature aloft. Each product is nicely integrated with ForeFlight Mobile&#8217;s Airports and Maps features.</p>
<p><strong>Does Stratus replace XM Weather?</strong></p>
<p>No. The products provided by Stratus and the ADS-B network differ. XM Weather offers a wider array of products and more coverage. <a href="http://www.foreflight.com/support/xmvfisb">This table</a> will help you compare and contrast ADS-B and XM and help you decide which in-flight product is right for you. Many pilots will find adequate ADS-B coverage within the areas they fly most frequently. Refer to the <a title="Stratus Coverage Map" href="http://www.appareo.com/primarymenu/products/stratus/stratus-coverage-map/">Stratus Coverage Map</a> to determine if there is coverage for your region.</p>
<p><strong>Are there any subscription fees associated with ADS-B weather?</strong></p>
<p>No. However, Stratus does require a current ForeFlight Mobile subscription, which you can purchase <a href="http://www.foreflight.com/pricing/">here</a>. ForeFlight Mobile Pro subscribers will enjoy improved position accuracy when using Stratus as a GPS source.</p>
<h3 id="traffic1">Traffic</h3>
<p><strong>Can I get traffic information from Stratus?</strong><strong> </strong></p>
<p>Yes, the first generation Stratus receives traffic on the 978 MHz (UAT) frequency.</p>
<p>The traffic you see on ForeFlight Mobile is only ADS-B traffic. ADS-B traffic only includes the air-to-air traffic received directly from another aircraft and traffic rebroadcast to your aircraft from an ADS-B ground tower.  Air-to-air traffic reports are only reported from ADS-B Out equipped aircraft; few aircraft are currently ADS-B Out equipped. You will only receive ADS-B traffic from a ground tower if two things are true: 1) your aircraft, or another one nearby you, is ADS-B equipped, and 2) you are in communication with an ADS-B ground tower.</p>
<p>Remember, ADS-B traffic, even at its best, is not a complete picture of nearby traffic and is not a substitute for looking out the window when fulfilling your responsibility to see and avoid.</p>
<p><strong>Why is my Stratus not displaying traffic information?</strong></p>
<p>Make sure that you are running ForeFlight Mobile version 5.1 or newer. Next, connect to your first generation Stratus and check on the Stratus Status page to ensure that the device is running firmware version 2.3 or higher. Firmware upgrades are done from the Stratus Status page by tapping on the firmware version. Finally, ensure the Traffic layer is turned on in ForeFlight.</p>
<h3 id="battery1">Battery</h3>
<p><strong>Is Stratus battery powered?</strong></p>
<p>Yes, Stratus includes a battery that will provide continuous power for up to 8 hours, which contributes to making Stratus operation wire-free for most pilots. You can charge Stratus using the included wall charger or using an accessory like one of the several commercially available 12V DC power adapters.</p>
<p><strong>May I charge Stratus from a laptop?</strong></p>
<p>No, laptops generally only supply up to 0.5 Amps of power per the USB 2.0 standard. Stratus, like an iPad,  requires a 2.1 Amp power source for it to properly charge.</p>
<p><strong>May I use a USB cable other than that one that was included with Stratus to charge the device?</strong></p>
<p>No, the included 3 foot USB cable is designed to enable optimal charging speed. Many other 3 foot USB cables will not be able to deliver as much power resulting in longer charge time. Similarly, a longer cable is not able to supply as much power as a shorter one and will also result in longer charge times.</p>
<p><strong>Will Stratus’s battery charge if it is both plugged-in and operating in an aircraft?</strong></p>
<p>Yes, Stratus will still charge its battery when running but only if it is plugged into a high-capacity 2.1 Amp charging source and only if the battery temperature is between 0 and 35 C.  If it is plugged in but the battery is too hot or too cold then Stratus may continue to operate but the battery will no longer charge to protect it from damage.</p>

			<content:encoded><![CDATA[<p><strong>STRATUS LIMITED WARRANTY</strong><br />
When purchasing Stratus (“Product”) manufactured by Appareo Systems, LLC (“Appareo”), the original end user (“Initial Customer”) receives a limited warranty (Limited Warranty) from Appareo. This Limited Warranty outlines the Initial Customer’s exclusive rights and remedies as relates to the Product.<br />
The Initial Customer receives an expressed limited warranty (referred to as the “Limited Warranty”) for the Product purchased from Appareo. The terms of the Limited Warranty are explained below. Additionally, State or Provincial law may adjust the terms of the Limited Warranty, or the State or Province may impose additional obligations or additional “implied warranties.” To the extent necessary to comply with those laws, the terms of the Limited Warranty should be read to adjust to those requirements only to the extent necessary to comply with such local law.<br />
If you are the corporation or individual installing or using the Product, you are asked to read the following terms and conditions carefully before installing or using these Product. By installing or using the Product, you consent to be bound by and become a party to the Limited Warranty. If you do not agree to the terms and conditions of the Limited Warranty, you should return the Product for a full refund prior to installation.<br />
<strong></strong></p>
<p><strong>PRODUCT LIMITED WARRANTY</strong><br />
Appareo warrants to you, the Initial Customer, that the Product will be free from defects in material and workmanship for one (1) year from the Product ship date from Appareo, subject to the terms of this Limited Warranty. Any Implied Warranty of Merchantability or for Fitness for a Particular Purpose, if applicable to the Product, is limited in duration to the period of ownership by the Initial Customer. This provision shall not create any Implied Warranty or Merchantability or of Fitness for a Particular Purpose that would not otherwise apply to the Product. To be covered, you must still be the owner of the Product at the time of the failure that results in the claim made under this Limited Warranty.<br />
This Warranty is void if any part not supplied by Appareo is used in assembly or repair of the Product, or if the Product has been altered.<br />
<strong></strong></p>
<p><strong>EXCLUSIVE REMEDIES UNDER LIMITED WARRANTY</strong><br />
If the Product proves to be defective in material or workmanship during the Warranty Period, and all Limited Warranty requirements have been met, your exclusive remedies, and Appareo’s sole obligations, are that Appareo will repair or replace the Product under this Limited Warranty.<br />
<strong></strong></p>
<p><strong>MAKING A LIMITED WARRANTY CLAIM</strong><br />
To make a Limited Warranty claim on your Product, you must do the following:<br />
1. Call Appareo at (701) 356-2200, write to Appareo at 1810 NDSU Research Circle North, Fargo, ND 58102, or e-mail Appareo at support@appareo.com and provide the Product’s serial number and date of purchase.<br />
2. Provide reasonable proof of purchase (for example, a sales receipt) that establishes you as the Initial Customer (the original end-user consumer purchaser) and which provides evidence that the Product was purchased within the warranty period of the event for which you are making a claim for warranty service.<br />
3. Appareo will provide you with a Return Materials Authorization number and shipping information for the return of your unit.<br />
4. Upon receipt of the returned Product, Appareo will inspect it and make a determination as to validity of the warranty claim. Appareo will respond to you within 15 days of receipt of the Product.<br />
5. If upon examination it is determined that the Product is operating within factory recommended specifications, you will be notified and may request that the Product be returned to you. You will be asked to pay a reasonable service charge and also for shipping expenses to and from Appareo.<br />
6. If it is determined upon examination that the Product is not operating within factory recommended specifications, but that the source of the failure was outside of the scope of this Limited Warranty, you will be notified of the estimated cost for repair of the Product to factory specifications. At this time you may request that the Product be returned to you without further action or that Appareo repair the Product as per the provided estimate and return the product to you. In this case you will be billed for the repairs and for shipping expenses to and from Appareo.<br />
7. If it is determined that the returned Product fall within the scope of this Limited Warranty, Appareo will repair or replace the Product at its discretion. Replacement Product may be new or factory refurbished at Appareo’s discretion, and shall carry the warranty of the original Product. Following repair or replacement, Product shall be shipped to the same location in the same manner as was the returned Product. Appareo shall pay all associated shipping expenses.</p>
<p><strong>THE LIMITED WARRANTY DOES NOT APPLY UNLESS THE INITIAL CUSTOMER:</strong><br />
1. Has properly operated the Product.<br />
2. Has installed and maintained the Product properly per any installation or maintenance instructions that accompanied the purchase.</p>
<p><strong>APPAREO DOES NOT COVER OR UNDERTAKE ANY LIABILITY IN ANY EVENT FOR ANY OF THE FOLLOWING:</strong><br />
1. Loss of or damage to data, records, or software or the restoration of data or records, or the reinstallation of software.<br />
2. Damage from any circumstance described as excluded below with respect to the product.<br />
3. Damages from fire, flood, wind, rain, rising water, leakage or breakage of plumbing, abuse, misuse or alteration of the product.</p>
<p><strong>NO DEALER WARRANTY</strong><br />
This is the exclusive warranty applicable to Appareo Products. No dealer has any authority to make any other warranty, modify, limit, or expand the terms of this Warranty in any fashion, or to make any representation or promise on behalf of Appareo.</p>
<p><strong>EXCLUSION OF CONSEQUENTIAL AND OTHER DAMAGES</strong><br />
1. The sole and exclusive remedies of the Initial Customer are those provided by the Limited Warranty. Appareo excludes any liability for personal injury under the Limited Warranty. Appareo excludes any liability for direct, indirect, special, incidental or consequential damages, whether for damage to or loss of property, loss of profits, business interruption, or loss of information or data.<br />
2. Danger: Do not use for medical or life support equipment or other high risk activities!<br />
3. Appareo does not sell their Products for use in high-risk activities. The Product is not designed or intended for use in hazardous environments requiring fail-safe performance or for use in any circumstance in which the failure of the Product could lead directly to death, personal injury, or severe physical or property damage, or that would affect operation or safety of any medical or life support device (collectively “High Risk Activities”). Appareo expressly disclaims any express or implied warranty of fitness for High Risk Activities. Appareo does not authorize use of any of the Products in any High Risk Activities.<br />
4. This Limited Warranty is governed by the laws of the United States and the State of North Dakota, without reference to conflict of law principles.<br />
